Privacy Policy
This Privacy Policy explains how DulySworn, LLC, a Texas limited liability company ("DulySworn," "we," "us"), handles information across the DulySworn website and the DulySworn hearing-preparation platform (together, the "Service"). We built the Service around a simple idea: practice testimony should not become a stored record. This policy is written in plain language on purpose.
1. Two kinds of people, two kinds of information
The Service touches information about two different groups, and treats them very differently: law firms and their staff, who buy and administer the Service, and the firm's clients, who use it to practice. Firm information is ordinary business contact and account information. Client practice information is handled under the ephemerality rules in Section 3, which are stricter.
Our role. DulySworn provides its practice sessions to law firms and other legal services providers (the "Firm"). When a Firm's client takes part in a session, the Firm decides why and how the session is used, and DulySworn processes the client's words on the Firm's behalf and on its instructions. DulySworn does not practice law and has no attorney-client relationship with participants. If you are a participant and want to see, correct, or delete information about you, contact the Firm that arranged your session; DulySworn will assist the Firm with your request. Participants use sessions under the Practice Session Terms; Firms use the Service under the Subscription Terms. [ATTORNEY REVIEW Oct 2, 2026: service-provider role paragraph added with the participant-terms batch]
2. Information from law firms
When a firm requests a demo or trial, contacts us, joins a feature waitlist, or opens a portal account, we collect what is submitted: name, firm, email, phone, and the content of the message. We use it to respond to the request, to provide and administer the Service, and to send occasional product updates. Every marketing email we send includes a working unsubscribe, honored promptly. We do not sell this information, and we do not share it with anyone for their own marketing.
For active firms we also keep the business records the Service needs to run: portal account details, plan and entitlement settings, access-code issuance records, and session usage and billing figures. Usage figures are counts and durations — not testimony.
3. Practice sessions: built to be temporary
A practice session involves the most sensitive information in the Service, and it is deliberately the shortest-lived.
Case details from the firm. An attorney may provide case facts to shape a session's questions. Those details live only as long as the access code they are attached to: up to seven days while the code is unused, then the client's 48-hour practice window from first use. They are deleted when the code expires.
What the client says. A session is recorded and transcribed so that it can run and so that the firm can review it; the screen the client sees before beginning asks for the client's consent to this, and the client may stop at any time. In a voice session, the client's spoken answers are transcribed and sent to our AI provider to generate the judge's next question. Session content is held only temporarily during the client's 48-hour practice window — solely so a hearing can recess and resume where it left off, and so coaching notes can be prepared for the client and firm — and it is deleted when the hearing ends or the window closes. We do not build a permanent archive of any client's testimony; the firm's seven-day copy described next is the only copy DulySworn stores, and it expires; the firm may download it and keep it in the client's file under its own rules.
Typed answers. Where a firm has arranged typed answers for a client who cannot use voice, or where a microphone cannot be used, the client's typed answers are processed and kept on exactly the same terms as spoken ones. In a typed session no audio of the client is recorded.
Coaching notes and transcript. At the end of a session, the transcript and end-of-session coaching notes are stored for the issuing firm and available in its portal for seven days after the session — a later session on the same access code restarts that period — then deleted. The client is shown only a short coaching summary on screen — or nothing, where the firm has turned the summary off — and never the transcript; there is nothing for the client to download or print.
Voice. Voice audio is processed in real time to run the session; the Service does not use it to identify anyone and does not keep voiceprints. [VERIFY before 1.0: confirm against the ElevenLabs transcription and LiveAvatar processing terms; the matching sentence is held out of the client acknowledgement until this clears] The Service is not offered for use from Illinois; participants confirm this before each session, and we may block connections from Illinois. [ATTORNEY REVIEW Oct 2, 2026: Illinois line now matches the acknowledgement and the firewall plan]
4. The vendors under the hood
DulySworn is built on established infrastructure providers, each processing information solely to provide their part of the Service: Anthropic (the language model that asks the judge's questions from DulySworn's own hearing design and drafts the coaching notes), ElevenLabs (voice synthesis and live voice conversation), HeyGen (the virtual judge's video), and hosting and data-infrastructure providers for the website, application, and short-lived session storage. We configure these providers not to use Service content to train their models where the provider offers that control, and we choose providers whose terms support the ephemerality described above. We have configured each provider to delete its copy of session content within 30 days of the session; one provider’s disaster-recovery backups may hold deleted data for up to 60 days before it is permanently erased. [VERIFY each line against the vendor data-flow map before publishing] We last verified each provider’s retention controls and data-processing terms on September 6, 2026, and re-verify them when a provider changes its terms. Plain-language descriptions of each provider’s retention posture appear on our Confidential by Design page.
Protection against automated abuse. Some forms and sign-in steps ask for a quick check, run by Cloudflare, that the person using them is not an automated attack. To make that check, Cloudflare receives technical information about the browser and the connection, including its IP address, at that moment. It receives nothing typed into the form and no portal content, testimony, or case details, and the check is used only to protect the form or sign-in. [VERIFY before 1.0: confirm against Cloudflare’s Turnstile privacy terms; added Oct 24, 2026 for the portal sign-in, widened the same day to the site’s forms, the chat, password resets and client code entry]
5. Cookies and tracking
The Service uses no advertising trackers and no third-party analytics that profile visitors. The only browser storage we use is operational: session tokens that keep a practice session or portal login working, and small settings such as language choice. If that ever changes, this policy changes first.
6. Security
The Service runs over encrypted connections (HTTPS), practice sessions require one-time access codes issued by the firm, portal and administrative access are authenticated, and internal access to systems is limited. No system can promise perfection; ours is designed so that the most sensitive information — practice testimony — is not retained long enough to become a target.
7. Retention, in one place
- Session content — the client’s voice and answers and the judge’s or officer’s questions: held only during the 48-hour practice window (which allows a recess and resume), then deleted, as described in Section 3, unless a legal hold (below) requires us to keep it longer.
- Attorney-provided case details: deleted when the access code expires — up to seven days unused, then the 48-hour practice window — unless a legal hold requires us to keep them longer.
- The firm’s coaching notes, transcript, and Preparation Record, including the name a client types to sign the ownership and testimony-goals acknowledgements: available in the firm’s portal for seven days after the session (a later session on the same access code restarts that period), then deleted unless a legal hold requires us to keep them longer. The firm may keep its own downloaded copy in the client’s file under its own retention rules. The firm’s usage history keeps only a signed/unsigned flag.
- The client’s acknowledgements (the practice notice, ownership, and testimony goals): kept with the session content and inside the firm’s seven-day Preparation Record; never in usage reports.
- Record of agreement: we keep a record that you agreed to the Practice Session Terms, for ten years, so that the agreement can be proven. It records the steps you completed and when (the orientation and knowledge check, each acknowledgement, the start and end of each sitting and its length, how many questions were asked and whether the session finished), the versions of the terms, the acknowledgement text and the system in force, which judge or officer persona and which AI models were used, the firm that arranged the session (its name, the representation attestation then in force — see the Subscription Terms — and the login that issued your access code), and a hashed connection identifier. The name you typed to sign, the type of immigration relief your session was configured for, and the technical description of your browser are stored in that record encrypted, with a key that DulySworn’s own systems cannot use to read them; only DulySworn’s administrator can open them, and only to prove an agreement. The record contains none of your words — no testimony, no case facts, no coaching text. Deletion requests do not reach it. [ATTORNEY REVIEW Oct 3, 2026: assent register — the one deliberate exception to the seven-day name rule, accepted Oct 2, 2026; contents enumerated to match lib/assent-register.js as built; encrypted-field sentence reflects the public-key design (private key held only by the administrator)]
- Legal holds: the periods above are suspended for a session when we receive notice of a claim, a subpoena or other legal demand, a bar or regulatory inquiry, or a request to preserve records concerning it. We then keep whatever material still exists for that session — material already deleted on schedule is not recovered — until the matter is closed, and we record that we did so in the record of agreement. A hold does not extend a participant’s practice window and does not reach copies held by our technology providers. We never delete session material by hand, and no one at DulySworn can. [ATTORNEY REVIEW Oct 3, 2026: litigation-hold policy adopted; this bullet mirrors it]
- Technical session events (for example, whether the microphone connected or a session ended early), used to confirm that sessions ran properly: kept with the usage history; they contain no testimony. [VERIFY the retention period against lib/session-log.js and the session-health records]
- Usage records for billing — session date, length, format, and relief type: thirteen months, counts and durations only, never a transcript.
- Copies at our technology providers: as described in Section 4 — configured for deletion within 30 days of the session, with one provider’s disaster-recovery backups holding deleted data for up to 60 days.
- Firm contact, account, and billing records: kept for as long as we have a business relationship and as required for ordinary legal and accounting purposes. Waitlist and inquiry messages: kept until acted on or deleted in the ordinary course.
[ATTORNEY REVIEW Oct 2, 2026: Section 7 restructured as a list; every period above must match the client acknowledgement and Subscription Terms Section 4 — one mismatch anywhere is a misrepresentation claim]
8. Children
The website is directed to law firms, not to children, and practice sessions are for adults. A participant under 18 may take part only with a parent or legal guardian present who continues the session on the minor's behalf, as the firm arranges; the firm confirms this when it issues an access code. We do not knowingly process a child's words outside that arrangement. [ATTORNEY REVIEW Oct 2, 2026: children paragraph aligned with the Practice Session Terms and Subscription Terms §3]
9. Your choices and contact
Unsubscribe from product updates using the link in any email. Ask us what we hold about you or your firm, or ask us to delete it, by writing to hello@dulysworn.com — we honor deletion requests except where a record must be kept for legal or billing reasons. If we receive a subpoena or other legal demand for session content, we notify the firm before responding so that it can assert any protection that applies, as the Subscription Terms provide. Postal address: DulySworn, LLC, 5900 Balcones Drive #14408, Austin, TX 78731.
10. Changes
If this policy changes in a way that matters, we will update the effective date above and, for material changes affecting active firms, say so directly. The current version always lives at this page.
If you opened this policy from your practice session, close this tab to return to it.
